    Terms of Service

1. Acceptance of Terms

By creating an account, deploying any cloud computing resource, or otherwise using the services provided by Nashcore Technologies, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our platform.

2. Account Security & Responsibilities

You are entirely responsible for maintaining the confidentiality of your account credentials, passwords, SSH keys, and API tokens. Nashcore Technologies assumes no liability for any unauthorized access to your virtual machines or data that results from compromised, shared, or weak user credentials.

3. Acceptable Use Policy (AUP)

You agree to use our infrastructure responsibly. Prohibited activities on the Nashcore Technologies platform include, but are not limited to:

  • Sending spam, phishing emails, or unsolicited bulk communications.
  • Hosting malware, botnets, illegal content, or child exploitation materials.
  • Network abuse, including launching DDoS attacks, unauthorized port scanning, or IP spoofing.
  • Unapproved cryptocurrency mining, plotting, or any sustained computational tasks designed to artificially exhaust hardware lifespans.

4. Payment & Billing

Invoices are generated automatically based on your active billing cycle (hourly, monthly, or annually). In the event of non-payment or a failed charge, cloud resources will be paused after 3 days of grace period and permanently deleted after 14 days of continued non-payment. Late fees may apply to overdue balances.

5. Service Level Agreement (SLA)

We strive to maintain a 99.9% uptime guarantee across our core infrastructure. In the event of an unexpected outage that violates this guarantee, compensation will be provided strictly in the form of account credits based on the compensation tiers outlined in our official SLA documentation.

6. Backups & Data Loss Disclaimer

While Nashcore Technologies may offer automated snapshot or backup features, the ultimate responsibility for disaster recovery, data redundancy, and verifying backup integrity rests entirely with you. We are not liable for any data loss, corruption, or hardware failure that affects your hosted data.

7. Suspension & Termination Rights

We reserve the right to immediately suspend, restrict, or permanently terminate your account and wipe all associated resources without prior notice if we determine that your activity violates our Acceptable Use Policy, threatens the security of our network, or harms the performance of other users' instances.

8. Intellectual Property

You retain full ownership and intellectual property rights to the code, applications, and databases you deploy on our infrastructure. Nashcore Technologies retains all exclusive rights, titles, and interests in the underlying cloud platform, web dashboard, and proprietary APIs.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Nashcore Technologies' total financial liability for any claims, damages, or losses arising out of your use of our services is strictly limited to the total amount paid by you to Nashcore Technologies in the three (3) months immediately preceding the event that gave rise to the claim.

10. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the provincial and federal courts located in Ottawa, Ontario.
